IT IS believed the Pomeranian was 11 years old before its untimely death.
Martin McGonigle kicked the dog after an altercation between him and Patsy Quinn in Ballyshannon.
According to The Mirror, McGonigle was having a heated exchange with 73-year-old Quinn and his son Kevin when his temper got the better of him and he kicked his opponent's dog. The dog, named Millie was sent flying in the air due to the force of the kick and landed in a nearby ditch.
It is said the Pomeranian, less than 10 inches tall died of a sudden shock and severe trauma from the sudden kick. It is said McGonigle was wearing steel toe capped boots when he attacked the dog, ultimately ending its life.
McGonigle was fined 300 euro for the assault on Quinn and sentenced to one month in prison for animal cruelty.
Kevin McGliney, inspector with the ISPCA praised the judge for the sentence: "This sentence sends out a very clear message that animal abuse will not be tolerated. We congratulate the gardai for their action in bringing this case to its conclusion."
"To lose a family pet from natural circumstances can be heart-breaking, but to lose a pet in these circumstances must be devastating."
